Deed of Variation

A Deed of Variation of a lease is a formal legal document that records agreed changes in a lease.

There are many reasons why a lease may need to be varied, possibly an error in the original lease or plan to it, or maybe the lease needs to be varied to satisfy a lender's requirement such as varying the term of a lease where some terms are below a threshold required by a mortgage lender.

Lease extension

Of recent, an increasing number of properties are defined and acquired as a leasehold property generally where they are a flat.

If you purchase a leasehold property you do so for a fixed period given in the lease known as a ‘Term’ which generally ranges between 99 and 125 years.

As the duration of the lease term decreases this can affect saleability of the property and you may consider the advantages of extending the term of the lease sooner rather than later as when the term ends, the ownership of your property reverts to the landlord.

The remaining term of a lease affects the value of the property: the shorter the lease, the less the property is worth. So, it is in your interest to either extend the term of the lease before it expires.

Shared ownership

Shared ownership conveyancing can be more complex than a straightforward purchase of a leasehold property and that's why you need an experienced shared ownership lawyer who can advise you on the scheme procedures.

It is an affordable home ownership scheme by the government whereby you purchase a share in a property and pay a form of rent to the housing association.

As part of a shared ownership purchase there is generally an opportunity to purchase more shares in the property in the future which is known as staircasing.

Transfer of equity

Transfer of equity means the process of adding or removing someone as a legal owner of the property and updating the Land Registry.

When you may consider needing a transfer of equity?

A matrimonial or cohabitee split of your jointly owned assets – you may agree that one of you wants to buy the other one out and remove them from the property title. This also could be down to a Court Order providing for the removal of one party from the title.

You want to gift your home to your children as part of your future estate planning (our experienced Private Client Department can provide you with advice on care home fees, inheritance advice and general tax planning.)

You may wish to add or remove another party to the property title i.e a sibling or relative.

What happens if you have a mortgage secured on the property?

If there is an existing mortgage, then you will need to apply to your lender for the consent before you proceed with any transfer of equity.

Do you have to pay stamp duty on a transfer of equity?

The simple answer is it applies to each individual matter and we will inform you if stamp duty is payable. If there is an exchange of money for the transfer to take place, then the stamp duty rules and criteria will be applied.

Right to Buy

The Right to Buy scheme allows council tenants to purchase their home at a discounted price.

Currently, the full scheme is only accessible in England and this is limited to £84,200, or £112,300 in London.

Can I Apply To Purchase My Council House?

You can buy your council house if:

  • It's your only or main home
  • You're a secure tenant
  • You've had a public sector landlord for three years
